1. Acceptance of Terms
By downloading, accessing, or using SuperNova ("the App"), operated by SuperNova Social App ("we," "us," or "our") at supernovasocialapp.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Eligibility
You must be at least 13 years old to use SuperNova. If you are under 18, you represent that you have your parent or guardian's permission to use the App. By using the App, you represent and warrant that you meet these eligibility requirements.
3. Account Registration
To use certain features of the App, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for safeguarding your account credentials and for all activities that occur under your account.
4. Description of Service
SuperNova is a social voice-based communication app that allows users to:
- Create and share Voice Threads that remain active for 24 hours
- Send messages that automatically delete after 30 days
- Use interactive physics effects in conversations
- Customize chat experiences with themes and wallpapers
5. User Content
You retain ownership of content you create and share through the App ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and transmit your content solely for the purpose of operating and providing the App's services. You represent that you have all necessary rights to post your User Content and that it does not violate any third-party rights.
6. Prohibited Conduct
You agree not to:
- Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Impersonate any person or entity or misrepresent your affiliation
- Upload viruses, malware, or other harmful code
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use the App for spam, advertising, or commercial purposes without authorization
- Violate any applicable laws or regulations
7. Content Deletion
You acknowledge and agree that Voice Threads expire and are deleted after 24 hours, and chat messages are automatically deleted from our servers after 30 days. We are not responsible for any loss of content due to these automatic deletion features, which are core to the App's design.
8. Intellectual Property
The App and its original content, features, and functionality are owned by SuperNova Social App and are protected by international copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written consent.
9. Termination
We may terminate or suspend your account and access to the App immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately.
10. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUPERNOVA SOCIAL APP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE APP.
12. Indemnification
You agree to indemnify and hold harmless SuperNova Social App and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes through the App or by email. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
